Terms of Service

Missedyu is a service that lets you upload information about a loved one — their name, a description, and optionally photos, audio, or video — and converse with an AI-generated voice and likeness inspired by that information.

All replies, voices, and likenesses generated through Missedyu are artificially generated by AI. They are not real messages from a real person, and they should not be relied on for advice, factual accuracy, or as a substitute for the person they are inspired by. Missedyu is intended for emotional connection, reflection, and remembrance — not as a substitute for grief counseling, therapy, mental-health care, or professional support.

You must be at least 18 years old to use Missedyu. By using the service, you confirm you meet this requirement.

You are responsible for keeping your login credentials secure and for all activity on your account. Notify us immediately at hello@missedyu.com if you suspect unauthorized access.

You may only upload content depicting, describing, or recording a person if you have the legal right to do so. By uploading, you represent and warrant that:

• You own the photos, audio, and video you upload, or you have permission from the rights-holder to use them.
• For a living person other than yourself, you have that person's informed consent to create an AI likeness, voice clone, and conversational simulation of them.
• For a deceased person, you have the legal right to recreate their likeness and voice under applicable post-mortem publicity, personality, and moral rights laws (which vary by state and country).
• You will not upload content depicting public figures, celebrities, or any third party in a way that could reasonably be confused with an authentic statement, endorsement, or communication by that person.

You agree to indemnify and hold Missedyu harmless from any claim brought by a third party arising out of content you upload or likenesses you create.

You agree not to:

• Upload content depicting a person without the rights described above.
• Impersonate any living person without their explicit consent.
• Use the service to harass, defame, deceive, defraud, or harm anyone, or to generate non-consensual intimate imagery or audio.
• Use the service to create deepfakes intended to mislead the public, influence elections, or commit fraud.
• Upload illegal, abusive, hateful, or sexually explicit content.
• Attempt to reverse-engineer, scrape, overload, or disrupt the service or its underlying AI models.
• Use the service in violation of any applicable law, including export-control, sanctions, biometric-privacy, or consumer-protection laws.

We reserve the right to suspend, restrict, or terminate accounts that violate these rules, with or without notice.

You keep ownership of everything you upload. You grant Missedyu a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your content solely to operate and provide the service to you, and to process voice samples to generate a voice model for your account. We do not use your memories or conversations to train public AI models.

Missedyu offers a free tier with a limited number of messages and a paid subscription for unlimited use. Paid plans renew automatically at the interval and price shown at checkout until you cancel. We may change pricing for future billing periods on at least 30 days' notice.

You can cancel anytime from your account. Cancellation stops future renewals; access continues through the end of the current billing period.

You may delete your account at any time by emailing hello@missedyu.com. We may suspend or terminate your account at any time for violation of these terms, for legal reasons, or if we discontinue the service. On termination, your data is deleted as described in our Privacy Policy.

All Missedyu branding, software, and design are owned by us. If you believe content on Missedyu infringes your copyright, send a notice with the information required under the DMCA (17 U.S.C. § 512) to hello@missedyu.com. We will respond to valid notices and may remove infringing content and terminate repeat infringers.

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated content may be inaccurate, unexpected, or emotionally affecting. Missedyu is not a medical device, diagnostic tool, therapy, or crisis service.

If you are in crisis or experiencing thoughts of self-harm, please contact a qualified professional or local emergency services. In the US, you can call or text 988 (Suicide & Crisis Lifeline). In the UK, call Samaritans at 116 123.

To the maximum extent permitted by law, Missedyu and its operators, officers, employees, and suppliers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the service. Our total aggregate liability for any claim is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. You and Missedyu agree that any dispute arising out of or relating to these terms or the service will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable rights you have under the consumer-protection laws of your place of residence.

We may update these terms from time to time. Material changes will be communicated by email or in-product notice at least 14 days before they take effect. Continued use after changes means you accept the updated terms.
